These terms and conditions are binding upon and enforceable against the individual or user registering an account (referred to as “youâ€, “yourâ€, “userâ€, “customerâ€, “yourselvesâ€) or otherwise viewing our website, Instagram page and/or Facebook page.
Duplication, copying or otherwise of any of this website, Instagram page and Facebook page and other account’s content and/or products is strictly prohibited.
If any provisions in these terms and conditions are unclear, we reserve the right to interpret such clause as we see fit. If you do not understand provision contained herein, it is your responsibility to contact Wijngaardt to clarify such a provision prior to registering an account and thereby accepting these terms and conditions.
Wijngaardt also reserves the right to change these terms and conditions at its discretion. It is your responsibility to regularly check and make sure you are satisfied with these changes. If you are not satisfied, it is your responsibility to deregister and stop making use of our services including websites and pages.
Registration of Profile and use of website
At Wijngaardt we always believe in knowing who our customers are, for this reason you are required to register a profile with us before making any purchases.
This does mean that you will need to provide and entrust us with some of your personal information including your name, surname, physical address, mobile number, your credit card or other payment information including your e-mail address and your password amongst others. We also make use of “cookies†on this website to track and improve user experience; these cookies also gather information and data about our users, although not of a personal nature.
We urge you to please never divulge your password and payment information to anyone including our staff. We will never ask you for this information over the phone or via e-mail. We will also not allow any updates of information other than through the update information link on this website. So please help us to keep your information secure by staying sceptical regarding any requests for information even if it appears to be coming from us.
We will keep your information and data confidential and have taken steps to ensure no-one outside of our staff has access to your information unless such information is required in order to deliver the products and services for which such information was provided to us. Notwithstanding this we cannot accept any liability for any damages suffered or losses incurred by yourself or anyone else from the unauthorised use of your personal information regardless of how such information was obtained, whether by error/negligence on the part of Wijngaardt and/or its employees and affiliates/suppliers or otherwise.
Wijngaardt also makes no warranty or representation that the content on site or any links to external sites, or pages or elsewhere are free from viruses, spyware, malware, Trojans, bugs or other programs data or code which may be harmful to your device including hardware, software and the data contained therein. You agree to not hold us, our staff or affiliates liable for any such harm, damage, loss of data or otherwise.

Products, Pricing and Delivery
All of our products displayed on this website are subject to availability. While we endeavour to show only products that are available for delivery, it may occur that such products and/or specifications are not available. You cannot hold Wijngaardt liable for unavailability of stock or services. The product details, specifications including the colour may also differ from that displayed on the website. It is also possible that the product may become entirely unavailable. Wijngaardt will try to make alternative arrangements and/or refund you (see refunds terms and conditions) as is appropriate.
All prices shown on our website are in South African Rands and we will accept payment only in this currency. Wijngaardt will ensure prices on the website are kept up-to-date, however, where the actual price differs from that displayed on the website, Wijngaardt reserves the right to charge a price that it deems to be appropriate and/or reject the purchase and/or to withhold delivery and/or refund you as it finds appropriate.
We deliver only within the Republic of South Africa to areas where we are able to deliver. Delivery will only take place once the funds have been received in the registered bank account of Wijngaardt Designer Goods (Pty) Ltd. Deliveries to remote areas may attract an additional delivery fee. Any delivery times provided are an estimate. We cannot guarantee any delivery times and accept no responsibility for late delivery of any items estimate whether due to error/negligence on the part of Wijngaardt and/or its employees and affiliates/suppliers or otherwise. We have outsourced all delivery and collection arrangements to third party service providers. We therefore cannot be liable for any loss or damage caused by them. Should delivery be delayed due to unavailability or other reason on your part, Wijngaardt reserves the right to charge an additional delivery fee should it be required. Wijngaardt will only deliver to the one of the delivery addresses registered on your profile, no telephonic requests for change in delivery venue will be accepted, except if it is to another delivery address registered on your profile. Update of delivery address on the profile must be made prior to placing an order as we will delivery will take place to the registered or selected address on the day of placing the order.

Transfer of ownership
Wijngaardt deems ownership of the product to be transferred to you upon delivery of the goods to you or any other person authorised to receive delivery of such item. This will include any person present on the property stipulated as your address for delivery when you have registered a profile.
Wijngaardt reserves the right to change when ownership is deemed to transfer at any time with or without prior notice.
Guarantee
All our merchandise come with a five-year guarantee which is a warranty against defects in materials and workmanship. Our leather goods are made from genuine leather and therefore each piece will have unique characteristics (dimples, folds, lines etc.) as well as colour unevenness, these are not considered defects. Due to the nature of the leather and other materials used in the product, our warranty does not cover natural wear and tear such as worn edges or corners, natural fading and softening of materials as these are all an expected occurrence. Leather can be cleaned and restored with a regimen of leather care products designed to clean, condition and protect. Please see our Care instructions page for more details on how to properly look after your product.
Any guarantee claim is validated solely at the discretion of Wijngaardt.
The following events/defects are not considered to be due to defective materials or workmanship and therefore will not be covered under this guarantee:
- Natural wear and tear
- Natural softening and/or stretching of the materials
- Natural colour fading
- Staining of the materials
- Friction rubbing or scuffing of materials, plating, foiling, leather colour etc.
- Denting, chipping or splinting of wood
- Any damage due to misuse, neglect, abuse or accidental damage
- Any modifications to the product after sale
- Tarnishing of hardware
- Rips, tears and cuts
- Chemical cleaners’ stains/burns
- Fire, water damage
- Third party damage
- Theft or loss
To validate any guarantee claim, the proof of purchase will need to be provided. The customer is responsible for delivering the product to our premises. Wijngaardt takes no responsibility for damages or loss of product en route to us. Wijngaardt reserves the right to reject a warranty claim after inspection in which case the customer will be responsible for collecting the item from us. Any repair done under this guarantee will be done with the outmost care, it may however not be possible to return the product to the condition it was sold in. We therefore do not guarantee perfect condition of the product after the repair is completed. Any timelines provided for repair cannot be guaranteed and we accept no responsibility for delays whether due to error/negligence on the part of Wijngaardt and/or its employees and affiliates/suppliers or otherwise. Once the repair is completed, we will deliver the product to you. See Wijngaardt’s delivery section for terms and conditions pertaining to the delivery of your repaired item.
Cancellation, Returns and Refunds
Any order or purchase can be cancelled at any time prior to delivery, please e-mail info@wijngaardt.co.za indicating you would like to cancel your order and we will process the cancellation and refund within 10 working days.
General returns
If you are not satisfied with your purchase, you may return items purchased by sending an e-mail to info@wijngaardt.co.za. The item must be in an unused and saleable condition together with the original packaging and with all accessories or parts (excluding items purchased separately).
Your refund will be given against the original payment card used to make the purchase. Note that we do not provide cash refunds nor are we able to refund to alternative cards and/or individuals to avoid fraudulent activity.
We will collect the product from you at no charge. Our courier is entitled to refuse collection of a product that is not properly packaged for transport. Please note any scheduled collection that is missed by yourself for any reason will result in a collection/delivery charge being payable prior to us arranging a second collection. Alternatively, you can arrange to have the product delivered to our premises at your own expense. Any damage to the product and or/it’s packaging that occurs in transit will be your responsibility and we reserve the right to reject the refund based on such damage.
After inspection and if all conditions are met as per these terms and conditions, we will refund you within 10 working days of accepting the product for return.
Products can be exchanged for a different colour or variation provided that such variation is available and at the same price as the product originally purchased. In such a case, we will collect the product from you and after inspection deliver the requested product to you at no charge.
Returns will only be accepted within 14 days of purchase. Unfortunately, we cannot accept any items for refund after this date but please refer to the guarantee section of this document for any quality related issues.
Returns of defective products
We do our best to ensure that the products we deliver to you are of a high quality and without defects. Please inspect your goods upon delivery and refuse delivery if you find any defects. If you are unable to do so please inspect and notify us on the day of delivery of such defects for a full refund or exchange. If we are not notified on the day of delivery, we will unfortunately not be able allow the return of the item.
General Disclaimer
The use of our services and merchandise is entirely at your own risk. We accept no liability whatsoever for any direct, indirect losses or liabilities incurred by yourself through using our websites, linked third-party websites, applications products and services or the information and content contained therein. By making use of our services you agree to indemnify Wijngaardt against any loss or damage suffered or liability incurred by yourself whether caused due to error/negligence on the part of Wijngaardt and/or its employees and affiliates/suppliers or otherwise; or due to incidental use of our services; or due to any act or omission by any of our staff or suppliers related or unrelated to our products and services.
Notwithstanding any other terms and conditions contained herein, our liability from any breach of any of the terms and conditions contained herein or otherwise shall be limited to the monetary value of any order placed with us at the time of placing such order.
